REGULATIONS formulated by the Minister of Co-operatives, Trade, Food, Water Supplies, Electricity, Sports, Youth, Women’s Cultural and Arts Activities of the Western Provincial Council, under the Western Province Sports Statute No. 1 of 1993 and Section 4 (9) b of the Western Province Sports (Amended) Statute No. 1 of 1998.

Regulations 

01. These regulations shall be cited as Sports Clubs (Sports Clubs set out with the sole objective of participating in sports, Sports Clubs existing in Institutions and Clubs maintained for sports activities) regulations.

 

02.

(a) All applications for registration of Sports Clubs, should be forwarded to the Sports Officers, appointed by the Ministry of Sports of the Western Province. Applications should be prepared strictly in accordance with the Form ‘A’, given in the Schedule hereto and should be forwarded through the Convener, with the signatures of not less than a minimum of 40 members (Men/Women), over the age of 17 years, together with 04 copies of the Constitution of the Sports Club, proposed to be registered.
(b) In respect of Sports Clubs (ii) and (iii) coming under (9) (a) of Chapter 4 of the Sports Statute also, a request, signed by a minimum of 15 Members (Men/Women), should be forwarded to the Sports Officer of the relevant Divisional Secretary Division, through the Convener, together with 04 copies of the Constitution of the Sports Club, proposed to be registered.

 

03. If the Provincial Director of Sports informs to make any appropriate amendments to the constitution of the Sports Club, regarding an application forwarded as mentioned above, such amendments should be effected and 04 copies of the amended constitution should be handed over to the Sports Officer of the relevant Divisional Secretary Division.

 

04. The documents mentioned below and the particulars of the Sports Club, set up after the inaugeral General Meeting, prepared in accordance with Form ‘B’ in Schedule 2 hereto, should be forwarded to the Sports Officer.

(a) 04 copies of a document, certified by the Chairman and Secretary, confirming the acceptance of the constitution of the Sports Club at the General meeting. 1 A
(b) 04 copies of a list containing the names, addresses and signatures of not less than 40 members who attended the General Meeting.
(c) 04 copies of the minutes of the general meeting, certified by the Chairman and the Secretary.
(d) 04 copies of the list of office bearers elected, giving their names and addresses.
(e) 04 copies of the application for the registration of the Sports Club.

 

05.

(a) Members should have a continuous residence period of at least 06 months within the administrative unit of the Divisional Secretary Division. (This will not be applicable to (ii) and (iii) Sports Clubs, coming under 9 (a) of Chapter 4 of the Western Province Sports Statute.
(b) Sports Officer of the relevant Divisional Secretary Division, should participate at the inaugeral meeting or the meeting to be held for the election of office bearers or for the extension of the registration of a Sports Club. A representative nominated by the Divisional Secretary could participate only in the event of the Sports Officer not being able to attend.

 

06.

(a) All Sports Clubs will come under the supervision of the Ministry of Sports of the Western Province and the Sports Club is bound to provide any information required.
(b) Western Provincial Director or a person nominated by him or District Sports Officer or Sports Officer in charge of the Division, is empowered to inspect any document relevant to the Sports Club, including record books and accounts books, at any time.

 

07.

(a) If requested by the Director of Sports, the Sport Club is bound to provide any subsidiary information, document or a register, which is considered as necessary, prior to the registration of the Sports Club.
(b) In respect of a registered Sports Club also, the Sports Club is bound to provide any subsidiary information, document or a register, if requested by the Divisional Director of Sports.

 

08.

(a) Registration of new Sports Clubs will be carried out from the 01st of September of every year till the 15th of January of the following year.

(b) The period mentioned in 8 (a) will also be applicable for the extension of the registration of a Sports Club. Further, the documents mentioned below, should also be forwarded for it.

(i) 04 certified copies of the minutes of the general meeting held for the election of office bearers for the coming year.
(ii) 04 copies of the audited statement of accounts of the previous year.
(iii) Names and addresses of the officers elected for the coming year.
(iv) Particulars regarding participations in sports competitions, training camps, seminars, organised by the Divisional Sports Officer.
(v) List of members giving their names and addresses.

 

09.

(a) An annual fee will be levied, as mentioned below, for the registration of a new Sports Club or for the extension of a registration.

(i) Rupees One Hundred (Rs. 100) per annum for Sports Clubs Formed with the sole objective of participating in sports activities. ‘
(ii) Rupees Five Hundred (Rs. 500) per annum for Sports Clubs in Institutions.
(iii) Rupees Three Thousand Five Hundred (Rs. 3,500) per annum for Recreation Clubs conducted for Sports activities.
(b) These payments should be made to the Divisional Secretary Office, to be credited to the general deposit account No. 600192 of the Provincial Ministry of Sports. A copy of the receipt issued for it, which has been certified as correct by the Sports Officer, should be attached to the application to be submitted to the Sports Officer.
(c) If the Provincial Director of Sports is satisfied with the documents submitted for the registration of a new Sports Club or for the extension of a registration, a certificate with the registration number, will be issued in accordance with Form ‘C’ given in Schedule (3) herein.

 

10.

(a) Cancellation or the registration or a registered sports club-

(i) Sports Clubs which have been identified as inactive by the Sports Officer, due to not implementing systematically, instructions given by the Western Province Sports Ministry or District Sports Officers or Sports Officers in charge of the Divisions.
(ii) Sports Clubs which fail to provide to the Sports Officers of the relevant Divisions, documents mentioned under Regulation 8 (b), within the specified time.
(iii) Sports Clubs which do not participate in inter sports competitions conducted under the sponsorship of the Ministry of Sports of the Western Province and in sports camps, seminars or activities relevant to sports.
(iv) Sports Clubs which do not forward to the Divisional Sports Officer, minutes of Committee meetings and General meetings conducted by the Sports Club.
(v) Sports Clubs which have been found guilty of a breach of discipline, after conducting a formal inquiry.
(vi) Sports Clubs which acts, contrary to Sport Clubs Constitutions, approved by the Director of Sports.
(vii) Sports Clubs in Recreation Clubs registered under 9 (a) (iii) of Chapter 4 of the Western Province Sports Statute, which do not spend fifty per cent (50%) out of its annual income for sports activities.
(viii) Sports Clubs, which have been found after inquiries, as having committed an act or activities, which in the opinion of the Provincial Director of Sports, as unsuitable.

 

When a Sports Officer/District Sports Officer or a responsible Officer of a similar position feels that the activities of a Sports Club are unsuitable and when the Provincial Director of Sports is informed of it, he has the full authority to cancel the the registration of the Sports Club, temporarily or to suspend the registration, by a decision taken after conducting an investigation.

Amendment of the Constitution :

 

11.

(a) If it becomes necessary to make any amendments to the approved constitution, it should be adopted at a General meeting, with by a two third majority votes of the members. Amendments adopted should be forwarded to the Director of Sports, through the Sports Officers, in 04 copies together with the minutes of the relevant General Meeting to obtain his approval.
(b) Amendments to the constitution will not be operative, until the receipt of the approval of the Director of Sports for the relevant amendments.
