Primary Courts Procedure(Amendment)


AN ACT TO AMEND THE PRIMARY COURTS PROCEDURE ACT.

BE it therefore enacted by the Parliament of the Democratic socialist Republic of Sri Lanka as follows :
Short title.
1.This Act may be cited as the Primary Courts Procedure (Amendment) Act, No, 4 of 1980.
Replacement of section 64 of Act No.44 of 1979.
Section 64 of the Primary Courts ‘Procedure Act, no 44 of 1979(hereinafter referred to as “the principal enactment “)is hereby repeal and the following section substituted therefor:

Stamp duty in civil actions.
64. All documents field in a Civil action instituted in a primary Court shall be exempt from the , the payment of stamp duty under the Stamp Ordinance:
Provided. however that in any such action, there shall be affixed to fine plaint of the plaintiff, the answer of the defendant and the plaintiff’s reply to the defendant’s claim in reconvention, as the case may be, a stamp to the value of one rupee.”.

(1) The amendment made in the principal enactment by section 2 of this Act shall be deemed to have come Into force of the date on which that enactment came into operation.
(2)Where, before the date of commencement of this Act ,any person has paid any stamp duty on any document other than a plaint of a plaintiff, an answer of a defendant of the plaintiff’s reply to a defendant’s claim in a reconvention, filed in a civil action instituted in a Primary Court, such person ;shall not foe entitled to have any such stamp duty refunded to him.
