Buddhist And Pali University Of Sri Lanka (Amendment)
AN ACT TO AMEND THE BUDDHIST AND PALI UNIVERSITY OF SRI LANKA ACT, NO. 74 OF 1981.

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows : –

Short title.

1. This Act may be cited as the Buddhist and Pali University of Sri Lanka (Amendment) Act, No. 30 of 1983.

Replacement of section 6 of Act No. 74 of 1981.

2. Section 6 of the Buddhist and Pali University of Sri Lanka Act, No. 74 of 1981, (hereinafter referred to as the ” principal enactment”) is hereby repealed and the following new section substituted therefor:”

“Affiliated colleges of the University.

(a) Any Higher Educational Institution in Sri Lanka or abroad; or

(b) any pirivena managing an educational institution,

may in writing apply to the Council to recognize and register such Higher Educational Institution or educational institution as an affiliated college of the University. The Council may register any such institution if such institution conforms to such conditions as may be laid down by the Council by regulation:

Provided that, if one or both of the leading pirivenas namely, Vidyodaya and Vidyalankara establish educational, institutions in their “respective Pirivenas and in writing apply to the Council that such educational institutions in their respective pirivenas be recognized and registered as affiliated colleges of the University, the Council shall subject to the preceding” provisions of this section register such institutions as the principal affiliated colleges of the University and financially assist to develop such colleges :

Provided further that, if any Pirivena specified in the Schedule hereto, establishes any educational institution in the Pirivena and in writing applies to the Council that such educational institution be recognized and registered as an affiliated college of the University, the Council shall subject to the preceding provisions of this section register such institution and financially assist to develop such college.”.

Amendment of section 25 of the principal enactment.

3. Section 25 of the principal enactment is hereby amended as follows :”

(1) in subsection (1) of that section by the substitution, for the words and figures ” established under the Universities Act, No. 16 of 1978 ” of the words and figures ” established or deemed to be established under the Universities Act, No. 16 of 1978 “; and

(2) in subsection (2) of that section by the substitution, for the words and figures ” established under the Universities Act, No. 16 of 1978 “, of the words and figures ” established or deemed to be established under the Universities Act, No. 16 of 1978 “.

Amendment of section 46 of the principal enactment.

4. Section 46 of the principal enactment is hereby amended in subsection (1) of that section, by the substitution for the words ” The Council may make regulations “, of the words ” The Council may, with the concurrence of the President make regulation”.

Amendment of section 48 of the principal enactment.

5. Section 48 of the principal enactment is hereby amended by the omission of the definitions of ” affiliated college “, ” educational institution “land” Higher Educational Institution” and the substitution therefor of the following definitions:”

” affiliated college” means any Higher Educational Institution in Sri Lanka or abroad or any educational institution managed by a Pirivena and recognized and registered as an affiliated college under this Act;

“educational institution” means any institution which has the necessary facilities acceptable to the University for conducting courses of study for – examinations of the University ; and

“Higher Educational Institution” means any institution conducting courses of study for examinations of the University.’.

Addition of Schedule to the principal enactment.

6. The principal enactment is hereby amended by the addition of the following Schedule at the end thereof:”

2. Balagalle Saraswathie Pirivena.”.
