Ruhunu Kala Kawaya(Incorporation)
AN ACT TO INCORPORATE THE RUHUNU KALA KAWAYA

WHEREAS an Association called and known as the. “Ruhunu Kala Kawaya ” has been established at Borella, Colombo for the purpose of effectually carrying out and transacting all matters connected with the said Association according to the rules agreed to by its members:

AND whereas the said Association has heretofore successfully carried out and transacted the several objects and matters for which it was established and has applied to be incorporated and it will be for the public advantage to grant such application :

BE it therefore enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows: –

Short title.

1. This Act may be cited as the ” Ruhunu Kala Kawaya ” (Incorporation) Act, No. 5 of 1991.

Incorporation of the Ruhunu Kala Kawaya.

2. From and after the date of commencement of this Act such and so many persons as now are members of the “Ruhunu Kala Kawaya” (hereinafter referred to as the ” Kala Kawaya “) or shall hereafter be admitted members of the Corporation hereby constituted, shall be a body corporate (hereinafter referred to as ” the Corporation”) with perpetual succession under the name and style of ” Ruhunu Kala Kawaya ” and by that name may sue and be sued in all courts, with full power and authority, to have, and to use a common seal and to change and alter the same at its pleasure.

General objects of the Corporation.

3. The general objects for which the Corporation is constituted are hereby declared to be-

(a) to foster and promote the traditional Ruhunu, Kandyan and Sabaragamuwa dancing techniques of Sri Lanka ;

(b) to conduct a school for the teaching of Ruhunu dancing techniques to the younger generation free of charge;

(c) to protect and promote, the folk music, games, customs and manners unique to Ruhuna and to educate the general public on the same ;

(d) to engage in any other activity conducive to the religious and cultural development in Sri Lanka ;

(e) to establish cultural contacts with international cultural organizations for the propagation of the national arts of Sri Lanka ;

(f) to exchange views and personnel relating to art and culture with any foreign organization:

(g) to conduct an all Island cultural festival to provide opportunities to amateur artists ;

(h) to affiliate with other associations for the promotion of arts in Sri Lanka ;

(i) to organize and maintain, a home for destitute and aged artists who have dedicated themselves for the promotion of the arts ;

(j) to conduct and maintain properly the ” Sithasuwa Sevaya ” which has been established to assist people to solve their psychological problems affecting them by using the dancing methods of ”Bali Thovil”:

(k) to conduct and. maintain properly the ” Yauwana Abhiwardhana Sevaya” to perform and discharge all activities connected with the education, industry and agriculture for the betterment of the younger generation ; and

(l) to create an awareness among youth, of the cultural values of Sri Lanka.

General powers of the Corporation.

4. Subject to the provisions of this Act and any other written law, the Corporation shall have the power to do, perform and execute all such acts, matters and things whatsoever, as are necessary or desirable for the promotion and furtherance of the objects of the Corporation or any one of them, including the power to open, operate and close bank accounts, to borrow or raise moneys, with or without security, to receive or collect grants and donations, to invest its funds and to engage, employ and dismiss officers and servants required for the carrying out of the objects of the Corporation.

Management of the affairs of the Corporation.

5. Subject to the rules of the Corporation for the time being-

(a) the Corporation shall have the power to receive any grants or donations in cash or in kind from any individual or any organization or from any corporate or unincorporate body of persons, whether in Sri Lanka or abroad ;

(b) Mr. Kalinga Obaywansa, M.P. the founder of the Kala Kawaya and its President for the time being, shall be the Life President of the Corporation, unless he resigns from the said office ;

(c) there shall be a Patron, three Vice-Presidents, a General Secretary, an Assistant Secretary and a Treasurer of the Corporation elected in accordance with the rules of the Corporation ;

(d) the affairs of the Corporation shall be administered; by a Board of Management consisting of such number of members as may be elected in accordance with the rules of the Corporation.

(e) the Board of Management of the Kala Kawaya holding office on the day preceding the date of commencement of this Act shall be the first Board of Management of the Corporation.

Rules of the Corporation.

(a) It shall be lawful for the Corporation from time to time, at a general meeting and by the votes of two-thirds of the members present and voting to make rules not inconsistent with the provisions of this Act or any other written, law for the admission, withdrawal or expulsion of members, for the conduct of the duties of the Board of Management, and of the various officers, agents and servants of the Corporation, for the procedure to be followed in the transaction of business and otherwise generally for the management of the affairs of the Corporation and the accomplishment of its objects.

(b) No rule of the Corporation for the time being in force nor any rule which may hereafter be passed, shall be altered, added to amended or rescinded except by the votes of two-thirds of the members present and voting at a general meeting of the Corporation :

Provided however, that no such alteration, addition, amendment or rescission shall have effect unless approved by the Board of Management.

(c) The rules of the Kala Kawaya in force on the day preceding the date of the commencement of this Act. shall be deemed to be rules made under this section, in so far as they are not inconsistent with the provisions of this Act or any other written law.

Debts due and payable to the Kala Kavaya.

7. All debts and liabilities of the Kala Kawaya existing on the day preceding the date of commencement of this Act shall be paid by the Corporation, and all debts due to and subscriptions and contributions payable to, the Kala Kawaya, on that day shall be payable to the Corporation for the purposes of this Act.

Corporation may hold property movable and immovable.

8. The Corporation shall be able and capable in law to take and hold any property movable or immovable which may become vested in it by virtue of any purchase, grant, gift, testamentary disposition or otherwise and all such property shall be held by the Corporation for the purposes of this Act, and subject to the rules of the Corporation, with full power to sell, mortgage, lease, exchange or otherwise dispose of the same.

How the seal of the Corporation is to be affixed.

9. The seal of the Corporation shall not be affixed to any instrument whatsoever, except in the presence of two members of the Board of Management who shall write and sign their names to the instrument in token of their presence and such signing shall be independent of the signing of any person as a witness.

Saving the rights of the Republic and others.

10. Nothing in this Act contained shall prejudice or affect the rights of the Republic, or any body politic or corporate or of any other person, except such as are mentioned in this Act and those claiming by, from, or under, them.

Sinhala text to prevail in case of inconsistency.

11. In the event of an inconsistency between the Sinhala, and Tamil tests of this Act. The Sinhala text shall prevail.
